1. Agreement to these terms

These Terms of Service govern your access to and use of Buildzy, including our website, applications, and related services. By creating an account, accessing, or using Buildzy, you agree to these terms.

If you use Buildzy on behalf of a company or other organization, you represent that you have authority to bind that organization to these terms.

2. The Buildzy service

Buildzy helps landscaping businesses create visual concepts, materials information, estimates, and quotes from photos and other information provided by users. We may improve, change, or discontinue parts of the service over time.

Buildzy is a business tool. You remain responsible for reviewing all designs, measurements, materials, pricing, taxes, permits, scope details, and customer-facing documents before relying on or sending them.

3. Accounts and access

• You must provide accurate account information and keep it current.
• You are responsible for safeguarding your login credentials and for activity under your account.
• You must notify us promptly if you believe your account has been compromised.
• You may not share access in a way that exceeds your subscription or bypasses account limits.

4. Acceptable use

You may use Buildzy only in compliance with applicable law and these terms. You may not misuse the service or help anyone else do so.

• Do not upload content that you do not have the right to use.
• Do not use Buildzy to deceive customers, misrepresent work, or create unlawful or harmful content.
• Do not interfere with the service, attempt unauthorized access, or probe its security.
• Do not reverse engineer, scrape, resell, or reproduce the service except as permitted by law or a written agreement with Buildzy.
• Do not use automated means to overload the service or circumvent usage limits.

5. Your content

You retain ownership of the photos, business information, customer information, prompts, and other content you submit to Buildzy. You grant Buildzy a limited license to host, process, reproduce, and use that content as needed to provide, secure, maintain, and improve the service.

You represent that you have all rights and permissions necessary to submit your content, including any permissions required from customers, property owners, or other individuals.

6. AI-generated output

Buildzy may use artificial intelligence to generate visual designs, takeoffs, estimates, quotes, and other output. AI-generated output can be incomplete, inaccurate, or unsuitable for a particular property or project.

You are responsible for independently verifying output before using it for bidding, purchasing, construction, safety, regulatory compliance, or customer commitments. Buildzy does not replace professional judgment, on-site measurements, engineering, or other required expertise.

7. Fees and subscriptions

Some features may require a paid subscription or other fees. Pricing, billing frequency, included usage, and renewal terms will be presented when you purchase a plan. Unless otherwise stated, fees are non-refundable except where required by law.

You authorize us and our payment providers to charge applicable fees and taxes using your selected payment method. We may suspend paid features if payment is overdue.

8. Buildzy property

Buildzy and its licensors own the service, including its software, branding, interfaces, documentation, and other materials, excluding your content. These terms do not grant you any right to use Buildzy trademarks or branding without written permission.

If you provide feedback, you allow us to use it without restriction or compensation.

9. Third-party services

Buildzy may connect with third-party products or services. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, including their availability, security, or performance.

10. Disclaimers

To the fullest extent permitted by law, Buildzy is provided on an “as is” and “as available” basis. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not guarantee that the service or any output will be uninterrupted, error-free, accurate, complete, or appropriate for your needs.

11. Limitation of liability

To the fullest extent permitted by law, Buildzy and its affiliates, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities.

To the fullest extent permitted by law, Buildzy’s total liability for claims arising out of or relating to the service or these terms will not exceed the amount you paid to Buildzy for the service during the twelve months before the event giving rise to the claim.

12. Termination

You may stop using Buildzy at any time. We may suspend or terminate access if you violate these terms, create risk or legal exposure, fail to pay applicable fees, or if we discontinue the service.

Sections that by their nature should survive termination will remain in effect, including ownership, disclaimers, limitations of liability, and obligations relating to your content.

13. Changes and contact

We may update these terms from time to time. We will post the updated terms on this page and revise the last updated date. Your continued use of Buildzy after an update means you accept the revised terms.
